All but 24 hours of jail time may be suspended. You may be sentenced to 12 months of probation, less any jail time served. If you violate any of the terms of your probation, such as failing to check in with your probation officer or driving with a suspended license, you could be ordered to serve out your full jail sentence. The judge may also order you to perform 40 hours of community service as well as attend DUI School.

For a DUI first offense, your driver’s license may be suspended for a year; however, your license could be reinstated after 120 days if you complete the necessary drug and alcohol education classes and pay a reinstatement fee. While your license is suspended, you may be eligible for a limited permit that would allow you to drive to and from court-approved locations, such as work and school.

Drivers under the age of 21 face different penalties if convicted of DUI first offense. If the driver’s blood alcohol content is above .02% but below .08%, he or she could face a six-month license suspension and 20 hours of community service. Underage drivers with a BAC of .08% or higher may have their license suspended for one year.
