Depending on the circumstances of your drunk-driving offense, your case could be heard in several different Gwinnett County DUI Courts: criminal, administrative and civil. Your DUI lawyer can represent you in each of these courts in order to increase the chances of winning your case.
After your arrest, you will appear in criminal court for arraignment. During this time, you will enter a plea of guilty, not guilty, or no contest. You should consult with a lawyer first before making your plea. If you plead guilty or no contest, you will be sentenced by the judge. If you plead not guilty, the judge will set your next court appearance. Your lawyer can then begin gathering evidence for your defense. Your case will either be heard by a judge or jury, who will determine the verdict.
If convicted in a Gwinnett County DUI criminal court, you could be sentenced to probation, fines, community service, DUI School, and even incarceration. The judge will use the minimum mandatory sentence guidelines to determine your sentence.
The administrative case is heard by the Department of Driver Services (DDS). After a DUI arrest, your license may automatically be suspended if your blood alcohol content (BAC) is over the legal limit or you refuse to submit to a chemical test. You only have 10 days to request a hearing with the DDS in order to contest your administrative license suspension, or you will lose your driving privileges 30 days after your arrest.
If you were involved in an accident while under the influence that caused property damage or personal injury, the victim may file a civil claim in order to recover damages for his or her medical expenses, lost income, pain and suffering, or the amount of property damage.
